1. Operator details

The car park at Trinity Centre Aberdeen ("Car Park") is operated by Burnett & Black Limited, as managing agent on behalf of the property owner.

References to "we", "us" and "our" mean Burnett & Black Limited acting as managing agent. References to "you" mean the driver, registered keeper and/or owner of the vehicle and any person using the Service.

Part A — General Car Park Terms

2. Use of the Car Park

2.1 The Car Park is available solely for the parking of private motor vehicles during advertised opening hours.
2.2 Parking charges apply from the moment of entry until exit.
2.3 You must park wholly within marked bays; comply with all signage, tariffs, height restrictions and speed limits; follow reasonable instructions from staff; use designated bays only if entitled; ensure your vehicle is securely locked with windows closed before leaving it; and ensure children and persons under your supervision are properly supervised at all times.
2.4 Prohibited activities include mechanical work or cleaning vehicles, selling/hiring/advertising vehicles, towing vehicles into the Car Park without consent, and parking for any unlawful purpose.
2.5 We reserve the right to refuse entry, or require removal, of any vehicle causing obstruction, nuisance, safety concerns or breach of these Terms.

3. CCTV and ANPR

CCTV and Automatic Number Plate Recognition systems operate for security, safety and parking management. ANPR data is processed for contract performance, legitimate interests in parking management, crime prevention and site security, in accordance with UK GDPR and our Privacy Policy.

4. Parking charges and VAT

Tariffs are displayed onsite and online and are inclusive of VAT unless otherwise stated. We reserve the right to amend tariffs at any time. VAT receipts are available on request or via your online account where applicable.

5. Liability

The Car Park is a public place open to all users; vehicles and their contents are parked at your own risk and we do not guarantee their security. We are liable for loss or damage only to the extent caused by our negligence, wilful act, breach of statutory duty or default. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability which cannot be excluded under Scots law. Subject to that, we are not liable for indirect or consequential loss, and our total liability in respect of any single parking event will not exceed £250 or such greater sum as required by law. Nothing here affects your statutory rights under the Consumer Rights Act 2015 as it applies in Scotland.

6. Lien, removal and abandoned vehicles

We hold a contractual lien over any vehicle parked in the Car Park in respect of unpaid charges and may retain possession until payment is made in full. We may move any vehicle where reasonably necessary for safety, obstruction or operational reasons. A vehicle left for more than 28 consecutive days without notification or valid ongoing payment may reasonably be treated as abandoned; we will make reasonable enquiries to contact the registered keeper and give at least 28 days’ written notice before disposal, with removal, storage, sale and associated costs recoverable from the vehicle owner and any surplus held for the registered owner on proof of entitlement.

7. Complaints and claims procedure

If your vehicle is damaged or you suffer loss while using the Car Park, inform a member of staff before leaving where possible, report theft or criminal damage to Police Scotland and obtain a crime reference number, and notify your insurer promptly. Claims must be submitted in writing within 14 days of the incident with full details and supporting evidence.

Part B — Online Payment Terms

8. Autopay

You must register accurate vehicle and payment details. By registering, you authorise us to charge your registered payment method for all parking charges incurred. If payment fails, you remain liable for the outstanding amount.

9. Pre-book parking

All bookings must be paid in full at time of booking. Pre-booking guarantees entry during the booked period but not a specific space. Overstays are charged at the prevailing tariff. By booking for a specific date and time, you acknowledge that the statutory 14-day cooling off period does not apply once the booking period has commenced.

10. Debt recovery and interest

We reserve the right to recover unpaid sums. Interest may be charged on overdue amounts at 4% above the Bank of England base rate, accruing daily from the due date, and we reserve the right to claim statutory interest and reasonable recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998 in respect of business users.

11. Force majeure

We are not liable for failure or delay in performing our obligations resulting from events beyond our reasonable control, including fire, flood, power failure, industrial action, terrorism or governmental action.

12. Third party rights

No person who is not a party to these Terms has any right to enforce them.

13. Changes to these Terms

We may update these Terms from time to time. Continued use of the Car Park or Service constitutes acceptance of the updated Terms.

14. Governing law

These Terms and any non-contractual obligations arising out of them are governed by the laws of Scotland. The Scottish courts have exclusive jurisdiction.
